Settlement Dispersment

After several years, my malpractive suit has finally been settled. At the time the case was taken, there were three lawyers in the firm, now there are only two. However, in the dispersment breakdown, the third attorny's fee was taken out of the remaining settlement money. Shouldn't they have gotten paid from the attorney's 1/3 fee?
