Legal Question in Military Law in Illinois
national guard AWOL follow up
Mr. Cave,
Thank you for the quick response. Some additional info:
The soldier has called USADIP and no AWOL/deserter status has been filed, he can still access all military websites (i.e. AKO, etc.), no adverse action paperwork has been put in his personnel file (he has online access), he was pulled over by police while AWOL with no adverse action being taken, and he recently conducted a crimiinal background check at his local police station and nothing came up. As previously noted, the soldier has six months until his nat'l guard contract is up. Given the circumstances, what type of discharge/characterization of service is likely? Also, what will happen if his service obligation expires and no adverse action is taken by the unit? Thanks again.
