Question

Is the wife entitled to a portion of husband's personal injury settlement? We live in Illinois the personal injury case is WI

My insurance has covered all his medical expenses. I took him to all his appointments, completed all his paperwork & responds to all his attorney's correspondences. My duties & responsibilities at home have increased due to his injury. My financial responsibilities to our family increased since he's been out of work. I had to use FMLA time to care for him. Now we are seperated (considering divorce). We have 1 child together. His injury disrupted his ability to perform sexually. He turned to illegal drug abuse, my insurance paid for inpatient rehab. I have worked tirelessly trying to get him disability, in home care, etc. I just feel like I've been used because now it is almost time for him to get the settlement he has moved in with another woman who he been acquaintances with for 8 months

If your husband has an attorney in Wisconsin, you should ask that attorney. If not, you need to repost this in the Wisconisn InjuryForum, unless you are in a divorce in Illinois, in which case you need to post in Wisconsin injury and ask your Illinois Family Law Attorney.

Mr. Padove is correct. You should post this question under the Wisconsin forum. Nevertheless, I strongly recommend you contact the insurer for the defendant and let them know that you expect to be on the settlement check. The legal term of art you are looking for is called 'loss of consortium'. Good luck.
