If what you have stated is true you have, at the least, a case for fraud. This is important because, if proven, you can get double damages and the defendant pays the bills.

Agreed and if you did not have a title search done when you went under contract, that could be a problem unless you were presented with what appeared to be title documents confirming their ability to sell, which would be really great to have. You are responsible for watching out for your own interests in any "business" dealings where seller and buyer are similar -- individual sellers and individual buyers -- and one side hasn't done something "fraudulent" (a material misrepresentation like ownership that you had the RIGHT to rely on -- such as a forged title document, etc.). If it turns out these people have ANY rights to the property, you may be able to record your contract against land title...but GET AN ATTORNEY ON YOUR CASE ASAP@
