Legal Question in Real Estate Law in Illinois

I had a client that came into our office and did business with us for a service. We charge a fee per transaction and the client never paid us and when things didn't turn out exactly the way they wanted it to happen, they didn't go thru with the transaction and never paid us. In the interim, this same client gave me what was a loan and said I can pay him when I finish a business transaction with him. So when I got to the end of the transaction, it was discovered this client was committing fraud and we couldn't go thru with the transaction. Now this client is demanding that I give him back the money from the loan and I don't want to give it back because he never paid me the fees he was suppose to pay and on top of it, I was misled that he was committing fraud. I need to know what are my options and if I am obligated to pay this client back? He is unaware that I am aware that he is committing fraud.

An attorney should review the "contract" you had with the client, and the "loan" documents. You may have a contract claim that could be defended on the basis of failure of performance, and the client may have an action to collect that could be defended on the basis of fraud in the inducement. Depending on how much the client owed and how much the loan was for, there may be an offset one way or the other. As Ms. Dockery said, consult with an attorney, in person, with the documents you have relative to the claims.
