Legal Question in Real Estate Law in Illinois

COmmerical Real Estate Renting

Dear Sir/Madame:

My frinds had a business and rented a space in a commerical building. They paid security deposit, but never got it back. The security deposit was $5,000, the landlord gave them invoice for $5,190 saying htat he needed to fix all those things. When asked to provide recipts for that, he didn't do it. We filled a complaint at the County Court. The landloard is saying we shoudl dismiss the case becuase we would never get back the deposit. Is it possible to win our case or would we really loose? Do we have the right to see the recipts by law?

Please adivse thanks,

Petra

The landlord should be required to prove that he made the repairs and that the tenant was responsible for the damage. You could submit a discovery request to the landlord. This can be difficult for a non-lawyer.

Good Luck
