Legal Question in Real Estate Law in Illinois
Condo
I live in a 10 unit condo, #5 & the guy in #10 had parties late night frequently. I called police, Board & management. This guy saw me coming up walk way, stood blocked my path to my unit calling me a crazy bitch. Our condo had a meeting telling guy party until 12midnight. Guy said I am an owner & I can do whatever I want. The guy became angry bought a house now has been crying to Board he cannot sell unit. Rented to couple said for 3 mos who fought turned into 12 months. Couple moved out now another divorcee male renter with 2 small children moved in who are very noisy. Our condo paid the fee 3 years ago not to have any renters. One Board member felt because of the economy to let the guy rent for the initial 3 months but the guy did not keep his word so the Board said no more renters. But the renter with 2 small tots has moved in & the noise continues. I am bothered by the fact that we tenants paid a fee not to have any renters & the Board is not living up to the rule nor the management enforcing the rule. Is there any recourse I can take with the Board & management because I am the owner being subjected to the many renters. I stated the guy has not had any activity to sell unit, no open house, real estate agent for 2 yrs Tha

Re: Condo
Thank you for your question. You could bring suit against the Board to compel them to adhere to the condo charter. They have a fiduciary obligation to do so, and to further act in the best interests of the current owners. Please let me know if you have any follow up questions - you can email me: [email protected]
