Legal Question in Real Estate Law in Illinois
I own a condo, and would like to know if the association president can place a management lock on the common entry door, and then demand that all owners surcure all further entry keys for him,or her at a fee of seventhy five dollars per key ?
We all ( thirty in all ) pay our assestments to the association president for all payments of the common elements, but don't feel that she should be locking us out the main entry doors. We own our units, and don't pay our mortgages to him,or her,but to our mortgage companys.
Can we also do a class action suit,if he of she doesn't comform, and remove tha management lock from the main entry doors ?

You should attend the next board meeting or if board meetings are not being regularly scheduled you should petition for an owners' meeting (you need 60% of unit ownership) to discuss this. If it is a security issue the action may have been perfectly justified. There are many "compromises" you make when you enter condo living -- it is a multi-family community. So ownership and mortgages are irrelevant. And your remedy would most likely not be in court -- that could take forever. Your remedy is to elect another board and reverse the policy. Sounds like you want to be active in your condo -- you should run for a board seat yourself. There are a lot of books and pamphlets out there for condo owners to understand how the condo works. Getting yourself educated on the processes will make you look good.
