Legal Question in Real Estate Law in Illinois
Eviction after Foreclosure
My home was forclosed, we recieved a letter from a Real Estate agent saying that they want to secure the property right away, we have not recieved an eviction notice yet. My question is, how much notice should you recieve to vacate the property?

Re: Eviction after Foreclosure
The fact that the real estate involved is your residence is helpful to you. However, the issue of your right to possession, and how and when that right is terminated, is complex and dependent on, among other things, whether you were a party to the foreclosure. You should consult a lawyer to determine your rights, including your right to redemption, and any right to possession during the redemption period. A letter from a Real Estate agent asking you to leave, vacate, turn over possession is not in and of itself sufficient to gain possession, unless, of course, you turn over possession voluntarily. I strongly recommend that you seek advice from a lawyer familiar with all of the facts before you change your position.
