Home disclosure

My husband and I bought a house last July, and on the seller's disclosure they wrote that they had no knowledge of any basement leaks or material defects in the flooring. (They had lived at the house for 8 years) After moving in, we discovered a significant portion of the (only) bathroom floor was rotted, and we have had 3 instances of water leakage into the basement. We had to pull up half the basement carpet, and it was pretty evident that there was damage before we moved in, because of water stains on the carpet. (We didn't see the stains before because the family was still living there, and had boxes and junk in the rooms.)

We didn't have a home inspection, mostly because our realtor advised us that it ''wasn't necessary and most people don't even have one done,'' which now I see was horrible advice.

Is there any legal recourse we can take to get the previous owners to pay for the repairs to the bathroom floor and fixing the water problem?

Do you have receipts for all the repairs? Have you written a demand payment letter to the former owners? Are you willing to sue the former owners and the realtor? Are you willing to pay attorney fees and court costs up front even if you lose the lawsuit? This answer does not constitute legal advice because you are not as yet my client.
