Legal Question in Real Estate Law in Illinois

Lifetime Leases

An organization I belong to has leased plots of land, which by zoning can have mobile homes placed on them for use as week end living with two week living once a year, to several members. In addition, again by zoning law the leasees must be members of the organization. The leases state that the leasee's must comply with the local zoning laws. We have some individuals who are living full time in the area, some of whom are widows of the original leasees and are not members of the organization. The leases are 'life time' leases.

Question 1. What are our options for getting the leasees to abide by the zoning ordinances.

Question 2. Are 'life time' leases legal in the state of Illinois.

Re: Lifetime Leases

Hello.

You should take legal action in the form of a

forcible detainer (landlord tenant suit) to have

the members not in compliance removed. As far

as I know, lifetime leases in Illinois are legal.

Your organization needs representation. Situa-

tions like the one you described can be tricky.

Assuming your organization has bylaws, they should be reviewed or revised to cover the situ-

ation you describe. I will be happy to answer

any additional questions that you might have.
