real estate commission?

To whom this may concern:

I am participating in a mock trial and my case deals w/ real estate. i was wondering if you could provide me with any answers, here is the case

So lets say that I have a real estate agent, now I went into contract with this agent to sell my house. The prospected buyer of the house put a contract on it, and I accepted the contract. Now that's all fine and well, but before closing, the house was destroyed, completley. The buyers rescinded their contract, which is legal. But now, the agent wants commission even though possession of the house was never transferred, is the real estate agent still entilted to commssion and if so why? The real estate agent is suing for commission (Heck v. Mueller)

The case took place in illinois, a lot of details weren't given, I am defending Mueller, Heck is the real estate agent suing for the commission.
