Legal Question in Sexual Harassment in Illinois
I Feel Extemely Violated
My question is this, I have worked in the service industry for 7 years for the same establishment, New owners took over this past year and kept me employed I took the demotion from head bartender/beverage manager to bartender and that was fine. I have been sexually harrassed by a bartender co-worker, I have had no contact with this person except in the workplace. He decides to make an acusation to the manager that he believes that i have been stealing (just so you know heis very good friends with the manager) I get a phone call over the phone telling me Im fired. How could they get away with this they have no proof that I took anything how could they acuse me of something i never did this is my integrity what do I do?

Under normal circumstances, you would be an at-will employee, who can be terminated at any time for any reason. BUT YOUR CASE MAY BE DIFFERENT DEPENDING ON WHETHER YOU REPORTED THE SEXUAL HARASSMENT TO THE EMPLOYER, AND WHETHER OR NOT THE EMPLOYER DID ANYTHING TO STOP THE HARASSMENT. YOU MAY HAVE A CASE DEPENDING ON ADDITIONAL FACTS.

Illinois is an at-will employment state which means that you may be released at any time and you may resign at any time.
However, Illinois does recognize a claim for wrongful and retaliatory discharge.
