Legal Question in Sexual Harassment in Illinois

frivolous harrassment complaint

I rented a room to a co-worker over the summer. She proceeded to stiff me for the rent. I'm in the process of filing a small claims suit against her. The last contact i had with her was in early november. Prior to filing my small claims suit i sent a demand letter asking one more time for the rent. Two days later she filed a sexual harrassment complaint against me. The company informed me of the complaint and said there was no foundation to the complaint and dismissed it. When i made them aware of the timing of her complaint they said no disciplinary action would be taken against her. Can i sue her for defamation?

In a quick word, no. However, I don't have all the available facts so don't take that as legal advice. The problem is that words like this don't count if in a work environment and the only person who knew of the complaint was your boss. If it was in confidence, in other words. It would need to have been spread to a third uninvolved party. That's a simple version of the law.
