Legal Question in Sexual Harassment in Illinois
Whether or not i have to testify
I used to work at a food chain and well there was a sexual harrassment lawsuit against one of the managers that worked there. I cooperated with Equal Opporntunity commission and there investigation. About a year or so later, i recieved a phone call from the girl's lawyer who was suing this food chain. I cooperated and answered all the lawyer's questions and i have no evidence other than what they have. Now, the lawyer wants me to fill out an affidavit and which could possibly lead to testifying in the case. Which now i am hestitant in getting involved due to lack of personal commitments and lack of interest. Since I have been hestitant the lawyer has threatened to supeona my testimony. Which brings me to my question, am i legally obligated to give an affidavit or my testimony if i am supeonaed, especially since its a case that i lack and have no desire to get involved?

Re: Whether or not i have to testify
I am guessing they want an affidavit for a motion for summary judgment which means there might not be a trial depending on what facts have already come out. You do not have to give an affidavit. If you are subpoenaed and the subpoena comes with a witness fee and mileage check, you do have to testify or risk being held in contempt if the attorney decides to enforce the subpoena.
