Legal Question in Wills and Trusts in Illinois

My father passed away in April, apparently without a will so his wife (not my biological mother) says. I checked with the courts and nothing has been filed with them. The wife told me their agreement was joint tendency meaning that if she went first everything went to him and vice-versa. I was wondering if there was a way to verify the truth of her story and do I have any legal rights to a portion of his assets being the only son?

Sorry to hear about your father. Thank you for your question.

The first place I would look would be the recorder of deeds office in the county in which he resided. Most of that information can be found online. I would search the deed for his home and find out if the home was, in fact, owned in joint tenancy.

As for bank accounts, etc. There isnt much you can do to compel her to tell you. Same thing with insurance proceeds. You can file a lawsuit to compel her to do so, but that may not be what you are seeking to do.
