Legal Question in Wills and Trusts in Illinois
What are the laws concerning inheritance of firearms in Illinois?
If firearms are not specifically mentioned in a will but fall into the possession of the deceased's family, how can a family member be in full compliance with the law regarding licensing, registration, etc?
1 Answer from Attorneys
If the firearms fall into the "residue", not being gifted to a specific individual, the firearms are probably going to be sold and the proceeds put into the estate for distribution to beneficiaries. The firearms need to be put in the possession of someone who has legal authority to hold them. Conversation should be held with a firearms dealer who can hold the weapons and sell them and return the sale proceeds to the executor. Every day that goes by that the arms are in the possession of someone without a firearms owners ID card is a violation of the law.
