Legal Question in Wills and Trusts in Illinois
I am a resident of the state of Iowa. My mother-in law, a resident of the state of Illinois, is revising her will and wants to make me her Power of Attorney. Can she do this, or does her POA need to be an Illinois resident? What about the Executor of her estate?

She can do it. Non-Illinois residents are qualified to serve as agents under IL POA and as executors of IL estates.

She can make you both the agent and the executor. However, in the long run sometimes it is cheaper for the estate to have a local executor.

Out of state is permitted but local is better. Oftentimes you may have to go through belongings, find the checkbook, allow repairmen into the house. Local is better.
