Legal Question in Wills and Trusts in Illinois
stock transfer
I have stock in my deseased fathers name and have all adequate paperwork but I don't have a copy of my will. do I need this to get the stock transfered to me or is there any other way to do this. I don't know if I can get a copy of the will. I am the sole trustee of my fathers estate and have paid for the funeral since there was no insurance. Plus he owned a house and upon his passing it was repossed. I think he had death insurance. Is there a way to find out and if he did have it is there a way to still get the house back. he passed may 3, 2007. thank you

Re: stock transfer
Thank you for your question. You have a number of potential issues here. Is it stock of a public company? Have you spoken to the Transfer Agent already?
If he had a will, was it admitted to probate? feel free to email me direct: [email protected]
Re: stock transfer
Lost wills are tricky. If you have no proof of what the will said, then you probably will be stuck acting like there is no will at all.
If you are the only child, then you should be getting a good chunk of the estate if not all of it, but you will probably need to take the stock and the real estate transferred through probate.
