Fell At Work

I fell while at work Oct 28, 2008, hit my head and neck shoulder and landed on my left hip. No xrays were taken for three weeks. First doctor released me the same day, gave me Ibprophen. Have seen 3 doctors, had therapy, 3rd Dr said Therapy is not working. Requested me to see Oesthopathic Dr. Nothing has been done Even though my neck bothers me a lot - I have worked every day. Will I get compensation outside of doctor visits?

You most likely need to consult with an attorney in person - you have the right to see two "chains of referral" of doctors.

A chain of referral means that one doctor refers you to the next.

It sounds like the first doctor provided treatment but no referral. It is unclear whether the "second" doctor referred you to the "third" doctor.

If you have exceeded your choice of doctors then you need to go back to either the first or second doctor for further evaluation and treatment. If you have NOT exceeded your choices, then go to any of the three doctors.

As you continue to have problems with your neck, you need to see a spine doctor or at least get a MRI. It should be your goal to get a written referral.

Your workers compensation insurance carrier then should authorize the visit or the test.

If the visit and/or test is not authorized then you definitely need an attorney.

To answer your next question - you are entitled to pay while off of work, medical treatment and compensation for your permanent injury if you are an employee who was injured while working.

It is difficult to tell exactly the next legal step until you take care of the next medical step.
