Legal Question in Workers Comp in Illinois

My husband worked for a company for 17 years, the company sold in December and my husband had to sign a non-compete letter to keep his job. Basically sign it today to be able to work or if you don't want to you are out of a job! He signed of course and in April fell inside the office and hurt his back. He is still being treated by our family dr. and a neurosurgeon for the damage. He was told he is 40% disabeled in his back. His "new" company fired him stating that their work comp dr. said he was fine and to go back to work. He was not able to and was still be treated by our drs. We now have a pending lawsuit against them. With a 40% disability will be be able to collect any disability from the injury? Will his non-compete letter hold up if he is able to get a new job. The injury happened in April and he is just now starting to collect unemployment in mid September. We are finically screwed right now since he made the bulk of our income. I need help!
