Legal Question in Workers Comp in Illinois

money amount

I fell at work in april of this year, and injured my left wrist (Im left handed) had therapy for tendionis, then ended up with a torn ligament in my wrist. I had 2 surgeries one in Aug to put in the pins and one in Oct to take them out. I will be finishing up my therapy and was told by the doc that I will have some range of motion issues. I have been working with my case manager he said that after he sees the Dr and therapist report he will then make an offer based upon previous payment for wrist injuries I would like to know how can I see those payments and what about the formula in the workmans comp book ( hand 205 wks x % of loss?) also I returned to work as soon as I could the job I am doing only requires me to write.what do I need to do to protect myself in the future when Im assigned something I cant do? thanks Deb

The amount you will be entitled to receive can be increased with the right presentation of your case.

For example our office can refer you to an orthopedic surgeon who can write a report which describes the nature and extent of your injury as well as your probable future limitations.

You can try to settle the case yourself but you will wind up with more money (and better protection) with an attorney.

You will need to pay 20% of the award for the perm injury in fees - but WITH an attorney, you generally get about 50% more than without an attorney.

That is why the insurance company wants you to settle BEFORE you get legal advice.

(The mere fact that you are checking up on them seems to indicate that maybe your gut instinct is correct!)

It is in the best interest of the insurance company to close your case at the least expense for them; and that is a quick settlement now, for less money and more exposure to risk.

If you have a lawyer you can even keep your medical open for a few years even after the trial of your case and payment, if that is one of your concerns.

Overall - You do not have to hire MY office but you MUST hire an experience lawyer or you will get short-changed.
