Legal Question in Administrative Law in India

Can we have right to go to the court or national woman commission?

My mom is in BSF since June 1992, as a post of Canteen Cashier without any rank & not in 89 days basis, my father was in BSF as A/E & expired in 1990. We are staying in Widow colony of BSF & we are 2 bro and 2 sisters.

BSF alloted quarter for 7 years for a widow & we are staying here from last 18 years, there are also some widows, who are staying here for long, but they don't employing. Presently the board members of BSF decided to throughout us, if we dont leave the quarter before 31 of January, as my younger brother join BSF in the post of Const. on compassionate ground in 2005.

6 staff are same as my mom in Canteen, 2 employees allotted quarter in the basis of employment and other 3 have their own house and remaining my mom is staying in Widow Colony. My mom was also applying time to time for allotment of quarter, But the Prov. Branch which allotted the quarter didnt respond, and gives us notice to leave quarter time to time. My sisters are young & we are trying for their marriage, Thats why my mother is not leaving the job and the canteen staff is also trying to shootout this problem and send a letter to the board for extension the period for one year.

If the board officials are not replaying positively, Can .....?

The best plan will be to go to High Court by way of a writ petition. It will be better if you engage an advocate. You are likely to get stay during the pendency of litigation, which may continue for 1-3 years.

You may not have any legal remedy except to make a representation to the authorities requesting for the relief you are seeking.
