Bounced Cheque

I got a cheque from a person for 40000 which has been bounced 3 months back.

Is it possible to take legal action now?

What is the process?

you have to represent it and if you have not issued notice of demand earlier you can well do so and if it bounced you can issue notice within 30 days provided you have not issued any notice earlier . if earlier notice was issued you can file delay condonation application and seek delay condonation however it is not that easy to finally succed in such matter

if the cheque has not expired then even now u can file the criminal complaint

otherwise you can file civil case anyway upto 3 year

yes, send one legal notice through an Advocate and then you can file a case under section 138 of N I Act

Yes,if six months from the date of issuance of cheque has not been expired.Redeposit the cheque for encashment and if the same bounce again then consult a local lawyer and proceed with the matter.

You can definately take an action. Contact a lawyer and serve a legal notice under Sec 138 of the NI Act.
