Cheque dishonoured, bounced

Had put in a cheque for Rs.50,000/- given to me thro my bank Citizen Credit Bombay on 15.9.07, the cheque was returned next day for want of funds. Is there any time limit to send the person issuing the cheque a legal notice?

You should have sent a notice within 30 days i.e. before 15/10/2007. You can make a fresh presentation of the cheque for collection and if it is returned immediately issue a notice and if it does not evoke any satisfactory response within 15 days of the receipt of the notice by him, file the complaint within one month thereof before the Metropolitan Magistrate court and if you are not in a Metropolitan city i.e. Mumbai, Kolkata or Chennai, before the Judicial Magistrate of the I class having jurisdiction over the police limits of within which the Bank from which you got the cheque returned given for collection is situate or the police limits of the place of residence of the drawer

Yes you may deposit the cheque second time giving him prior information. In case if it returns you can issue legal notice next day itself.

Yes,within 30 days i.e.one month from the date of notice of dishonour of cheque.You may redeposit cheque if six months period of cheque has not expired and can get issued notice.
