Starting a Small Home Based Business In India

Dear Sir,

I am planning to start a small herbal skin care home based business. I will be selling it online only through my website. Its only dry herbal facial pack powders, no liquid, no preservative will be used. Do I need to apply for any license for this?

I will also be selling it internationally. Please guide me on this.

Hi Pooja

First of all you must obtain a Sales Tax / VAT No from your local tax authorities of your area.

Second, depending upon the material you use or produce, you may require a Licence under the Drugs & Cosmetics Act.

Third, depending upon the number of persons you employ, you may need to get your operations registered under the Factories Act.

Fourth : you will need to determine if you want a "Sole Proprietorship" firm - i.e. business owned by an individual; or a "Partnership firm" - means business owned by more than one person; or a Private/Public Limited Company. If you want to form a company, you will need to get it registered with the Registrar of Companies of your area and obtain a Certificate of Incorporation and Commencement of Business. It is not mandatory for getting your sole-prop or partnership firm registered. But it is always desirable to get your business registered.

There are a few laws which may depend upon the premises, volume and nature of business - only trading or including manufacturing etc.

Be careful about the brand name or the business Logo you intend to use. You may want to get your brand name or Logo registered under the Trade Merchandise Act.
