Legal Question in Consumer Law in India
A complaint filed in Consumer redressal Dist. Forum was dismissed as my Advocate did not attend court on three consecutive final hearings. He also did not apprise his junior about the case. When defeciencies in his services were brought to his notice he filed an appeal before State Forum wherein he had prayed to set aside Dist Order as it was based on some wrong report & to pay the complainant the damages prayed in the original complainant based on fresh evidences. The State Forum set aside Dist. Order but remanded the case back to Dist Forum for fresh hearing based on fresh evidence. My Advocate is refusing to fight the case in Dist Forum. Is it O.K? Is he not leaving the case half way & thus again giving me defecient services?

He has a right to leave the matter at any stage after giving you a notice of his intention to do so.
Your advocate has failed to protect your interest and it is sheer negligence and against
the normal code of conduct and ethics of the profession of Advocate, and for his misconduct
you have suffered immense loss, if the advocate's plea is not reasonable, you the may
complain to the respective Bar, where the advocate usually practice and to the State
Bar council for sheer negligence and reaching harm to you,
see he has bring you back from where u have started he may have left you in between and have not filed appeal .so if he dont want engage a new lawyer .as if he wuld be forced he will further not represent your case well ....so why again a trouble.
