Consumer Protection and Cheque Cancelled

I have filed a claim against a local

hospital in the consumer court. All

said and done I have also not

honored a cheque for the hospital

charges by cancelling it. I have

intimated them verbally that I

would wish to settle the same in

the consumer court and would only

pay if the court directs. what action

can they take against me ? Should I

pay them the dues ?

if cheque is dishnoured they can file case of cheque bounce against you

You have to intimate them in writing by taking their acknowledgement on duplicate copy of the letter otherwise they can file a case u/s138 NI act.

Dishonour of cheque is offence under section 138 of the Negotiable Instrument Act. They may initiate criminal proceedings against you.

You may express your willingness to pay by filing an appropriate application in the court in your pending case. Your case in consumer court may be a good defence if they proceed to initiate proceedings against you u/s 138 NIA.

If in case cheque is dishonoured then they can file a case of cheque bounce against you.
