Delay in possession of Flat

Dear Sir,

I purchased a flat in Oct 2006 in Indirapuram Ghaziabad , and as per the builder (Shipra Estate Developers) documents I were to get the possession by Nov 2008 but I hav not got the possession till now. Its Already 6 months delayed and looking at the progress of construction It doesn't seem like getting completed in next 1 year also. In the initial agreement I signed there is one clause according to which ''In case of delay in possession due to unforeseen circumstances the builder is not liable to pay any penalty''. I hav already paid the full amount of flat to the builder. Pls. inform me what can be done in this case as I am desperate either to get my full money back or get possession of the flat.

In the instant case your right has surely been

infringed and you have every right to claim

compensation or come out of this agreement

irrespective of any such adverse clause.

and there is a act prevailing in real estate sector which shall safe guard your interest.

You should lodge a complaint with the consumer forum. It is better to give a notice before approaching the court. It is better to engage a lawyer.
