Individual water connection

Dear Sirs,

I own and reside in an independant bungalow within a private township. The builder has developed 11 projects and providing Drinking water 100 liters/day only.

My house was constructed in year 2000 & the Property assessment was done in Apr�2002 only!� for the builder had deviated the town planning regulations and subsequently failed to regularize the same, for which he pays the penalty.

At this juncture, the corporation states that THERE ARE APARTMENTS AND HENCE CAN NOT PROVIDE AN INDIVIDUAL WATER CONNECTION!

Now my request to you is that kindly advise how can I go about legally to obtain the said water connection and also to see the positive result in short span of time.

Kindly help me out with a solution and kindly give me some reputable lawyer's names in coimbatore , I will be very grateful!

Dear Sir,

In your circumstances of facts you have to make an application for individual water connection to your local municipal corporation. In case the corporation refuses individual water connection you may either file a writ petition before High Court or you may approach your District Consumer Forum and file a complaint under The Consumer Protection Act, with the help of some local lawyer.

Please contact a local lawyer who is aware of the local municipal laws of your area, in order to find out whether you are indeed entitled to receive water connection or not.

If you find that you are entitled to water connection, then you may have an appropriate remedy in a Writ Petition before the Madras High Court, for which your local Advocate will be in a better position to advise you after considering all relevant facts and circumstances and documents of your case.

However, please note that prior to making the Writ Petition, you may be required to make a fresh application to the Municipal authorities for a water connection, as it appears that the earlier application for water supply was made by the builder, not by you personally.

An alternative remedy may also be available before the Municipal authority itself, subject to the provisions of your local municipal law.
