Legal Question in Consumer Law in India
During the payment of instalment, the builder was not present for giving the signed documents and buyer afterwards had gone on business trip. The builder charges the seller for the delay in payment of instalment.
Currently, the builder is not giving the possession on the time as budget and has moved ahead by approx 5 months.
Kindly guide for non payment of the debit note, whether to go under MOFA or do a consumer compliant.

You are probably right in not giving the installment without the signed document. You should move the consumer forum for the compensation as the deficiency seems to be apparent on the part of the builder. But before that serve him a legal notice.
