Sanction of loan under Consumer Complaint Redressal Forum, Bhagalpur, Bihar

Whether I can lodge a claim for refusal for not sanctioning & not disbursing loan? Bank has not provided me any Sanction Letter. They have processed the loan application, made legal searches, accessed valuation of my agricultural land and created registered mortgage of land. I don't have any documentary evidence, however I can obtain few papers related to legal seach, copy of registered mortgage of land etc.

1. There is no apparent deficiency of service. It does not appear you have a right to get loan.

2. If you have paid fees while applying for loan and if there is undue delay in performing the task in lieu of fees, you can lodge a complaint for deficiency in service.

Dear Querist, Prior to amendment carried in Consumer Protection Act in 2002, these matters were regular consumer matters, after the amendment the same has been barred.

There are landmark Judgements on this aspect from NCDRC.

nOW YOU HAVE TO SHOW THAT THE lOAN WAS NOT FOR COMMERCIAL GAIN.

Other remedies are Civil case only for damages.

Regarding Consumer cases, you can give it a try as the Judge or Opposite side counsel may not pose you any opposition on this legal position, and you may succeed also.

As far the facts you have given it appears that you dont have a right to get a loan.
