Legal Question in Family Law in India
me and my husband have signed a divorce deed on 100 rs stamp paper and is notary executed. in the deed it has been written that child custody should be with me and he will pay me 20,000 maintenance per month. we have shown living separately since 1.5 years. Also, we have stated in the deed that when we need divorce in court both of us will agree to go for mutual consent. now he refuses to pay the money and tortures me mentally by sending cruel sms on mobile. my daughter is 6 yrs sold and i stay at my parents place. he comes here every weekend to meet daughter for 2 days.I work and earn money and he goes to my office sometimes, keeps inquiring about me, threatened my boss because of which i have lost the job. since court order takes a lot of time ,i do not wish to go for divorce proceedings until it is mutual. please advice.

you need to file a petition for divorce if you want the marriage dissolved. in the meanwhile you can also file a case for maintainence for the child and yourself if you are still unemployed
