Legal Question in Immigration Law in India
Hi,
I am in India and hold a valid H1b with visa stamped.I have been to US once.Now am planning to do my higher studies in US and also got my I-20.
My question is:
1.Will i get F1-Visa ,even though my H1 is still valid?
2.Will Visa Counselor will reject my visa thinking me as a potential immigrant?

You should apply for F-1 visa; the visa counsellor may consider your case as very genuine and may cancell your H-1B at the time of granting you F-1. On the other hand, if your job is still surviving and you are willing to work there, you may go on H-1B, and continue your studies on part time basis.
