Legal Question in Employment Law in India
Hi All,
I was recruited by a IT company during the Campus Interview in April 2007 (i.e. During my final year of B.Tech IT (2008 Batch)). Then i completed my graduation in May 2008. During these times the Company HR asked details like end of semester date, updated contacts, address, Project details, profiles etc through various mails during these times. Then they said they ll inform the date of Joining in August 2008. So I didnt search any jobs. No communication upto september 2008. Then they mailed, "due to market situtions we will postpone the DOJ". Upto July 2009, they said they will finalize the DOJ and inform to me' to the mails i sent. So i was waiting their call. In October 2009 I came to know that they called 2009 batch. It was a great shock to me. I again mailed them regarding the DOJ. There was no reply from them. So i included the Chief HR email id in the mails i sent. Then today they called me telling that they cant favour the offer due to market condition. Then how come they call 2009 batch. Now they are saying that calling 2009 batch is of management decision. Because of them i wasted 2 fruitful years. I might earned atleast 5 laks if I joined in other company. I need law to help me. Can i file a case against them?? I have the emails as evidences. Please advise me on this.

You can definitely file a case against the company as they have cheated you by breach of promise. Since you have the proof emails, it should be a strong case.
Issue a lawyer notice for compensation and then go ahead for the case.
