Legal Question in Legal Ethics in India

We are employing a lady attendant for our 85 year old mother in our home in Chennai, India. The agency which has deputed the attendant is taking the fixed amount for six month duration and the monthly payment in full is to be paid to the attendant directly.

In a fortnight's experience, we find the lady is behaving roughly with the patient; she is demanding her food to her specifications from the kitchen; she frowns at the patient and others in the house when the patient needs her attention for toilet in the night; she objects to afternoon conversation entered into by the patient with visitors who come to enquire on her health; she says she has to sleep in the afternoon and wants silence to be maintained. Presently we are keeping quiet.

We are not clear as to what legal complications will arise if we enter into advising her and in case she is not listening we raise objections to her behaviour and ultim,ately terminate her thru her employer.

You have a right to complaint to the agency who deputed her and ask for a substitute as you have paid them.
