Legal Question in Real Estate Law in India

Dear Sir ,I have purchased reasle flat in June 13 by paying stamp duty & regst. fees @3lacks & part payment to owner @7 lacks . when I submitted original aggrement copy to bank , I came to understand that since builder of this building has blacklisted on 2007 ;bank will not disburse loan, hence I need to cancel the aggrement . But now owner dosent able to pay money lost on account of stamp duty & regst. fees . Pls. advise how I can get this money back from owner ?I have put clause of refund in aggrement already.

You can file a suit for money recovery, in case it is specifically mentioned in the agreement about the refund of these expenses.
