Legal Question in Real Estate Law in India
Father bought property. After father died more than 25 years back relinquishment deed registered was given in favour of mother by all the sons including married sister. Four brothers live in the same property except one who lives outside.
Now mother has become old and may gift this property to the all the in equal proportion. Out of five brothers, three brothers got this property gifted in their names. Two brother possess a part of land in the same property but one who got gift does not possess any part of the land in the said property and occupied by other brother who is not willing to give that part of the land to him.
My question is:
Does any brother those live in that house have rights to challenge mother decision for giving property to the brother who does not live there even if mother gifted more property to him.
We are told that they will try to established that mother is not physically fit and put pressure on her. Mother is around 76 years old.
