Legal Question in Real Estate Law in India
I hve given loan to a friend against his shop in cash and write it down on a stamp paper that if he fails to return the amount w/h interest after two years of term period then i hve a clause mention in the agreement that i can recover my amount by selling his shop.pls guide whether its necessity to get this type of agreement registered in the court ?

you cannot sell the shop even if it is mentioned in the agreement. at the most, you can file a suit for recovery and in case he does not pay the amount, you may file the execution and get the shop attached. how much is the amount of money have you given him and how is it paid...e.g. cash or cheque.
