Legal Question in Real Estate Law in India

My widow sister wants to sell DDA freehold flat (in the name of deceased husband), left in the name of my sister in will. She has major son and minor daughter. She wants to buy new flat. What are the legal implications? Should she get permission to sell the property? or get mutation in her name and sell it? Pl guide.

One needs to look into the terms of WILL to opine on your question. Since your sister has a minor daughter, she would certainly need permission / appointment as Guardian from court of the District Judge

Get flat first transferred in the name of your sister.

This may also be a term from prospective purchaser.
