Legal Question in Wills and Trusts in India

My brother passed awaya without a will. My father had a will for his property however my brother gott his share transfered into his name as a purchase. since he died without a will how can we transfer the property into his childrens name.

If you are talking of the property your brother transferred for himself as a purchase then simply have the same mutated in the municipal record after producing the death certificate. Intimate the registrar. There is no need to transfer in the children names. This advice applies only if there is no dispute amongst the children. If there is dispute then file a suit for partition by the all legal heirs of your brother and then the court will order the same. The latter would we very expensive due to court fees and time consuming.
