unregistered will

Hi My grandfather left with a

unregistered will with sign of two witness and transfer major

property on my father name but my

uncle and their sisters are gone in

court and saying that will is wrong

and not registered

Registration of Will is desirable but not mandatory(Compulsory) under the Law.

You may need to contest the court case on the basis of will. The court decision will depend upon pleadings, evidence on record and over all appreciation of the case by the learned Judge.

it is not compulsory to get the will registered and unregistered will is also considered to be genuine provided the signature of the executor and witnesses is genuine.
