Attorney attempt to collect a debt

I made previous arrangements with my attorney to pay $100 per month. I had a major change in financial circumstances and am unable to pay the amount. My attorney has taken it to small claims court scheduled for April 26. I just received notice April 15. What kind of justification do I need to request a continuance and is there a time limit to submit a continuance request?

You need to cite the reason for the continuance, such as a conflict that you cannot change, the fact that you won't be in town, etc.

The court won't grant a continuance just because you won't be able to pay.

You would need to request it at least 10 days before the scheduled hearing.

Call the court today! Request a continuance and ask the procedure-they will let you know-if you are going to be represented, tell them you need to hire counsel-it may depend on whether or not the plaintiff will agree
