Legal Question in Credit and Debt Law in Indiana

Collecting on private daycare bill

My wife runs a home daycare. 3 clients have run up bills of $538, $350, and $208, then pulled their kids out. Repeated phone calls and letters have elicited no response. If we take them to small claims court and win how hard will it be to collect? Can we garnish wages and add collection fees to bill?

Re: Collecting on private daycare bill

If you win in court, you can ask the court to execute on the judgment you have. Read the court information sheets or get a book on the subject to see how to do it. (Or hire an attorney) You can garnish wages once you have a court order, but you have to get a judgment first and then get the court to order the garnishment. If your contract for services allowed for collection costs, then yes, you can get them. If it didn't, then no, you cannot ask for them.
