Can collectors call you or otherwise harass you on a Sunday for payment?

If the collector is working for the same company (such as a sears debt collector is calling on a sears debt)that you owe, you do not have a whole lot of relief from their activities. However, if the debt collector is a separate entity from the company who you have the debt with (such as National Revenue Collections, Inc. working on behalf of XYZ Dept Store)the debt collector must comply with the Fair Debt Collections Procedures Act (FDCPA), which limits the times and frequency that a professional debt collector may telephone a debtor. If the debt collector violates the FDCPA, then the debtor can recover actual costs, a statutory fine of $1,000, and attorney fees. Most debt collectors hate the FDCPA, and most of them follow it. However, there are enough debt collectors out there who regularly abuse it, hoping that the debtor is uninformed of the requirements of the FDCPA. You need to consult with an attorney if the debt collector is a separate entity and if it has been calling you alot.
