Taken to court - agreed to make payments - judge set no amount - lawyer for agen
I was taken to court for various medical bills. My ex-husband was supposed to be there too. I explained that he was in jail. I agreed to make payments on the bill. The judge set no amount - before i could even make the first payment i was served again - this time for my ex-husband who is still in jail, the company that we used to work for to garnish our wages, and myself. Again i called the lawyer for the collection agency - explained that i was unemployed, my ex was in jail and that neither of us worked at the company named. I asked if he wanted me to go ahead and send the payment in to the court and he told me that the amount i was going to send was not acceptable, to not bother sending it. I am a single mother of two and i told him that I could only afford to send so much a month until either my ex takes responsibility for his part or i go back to work. How can i get them to understand that i only have so much and i can't pay the amount that he wants each month because it is more than i have total income?

If you have no real estate, no job and no bank account, they cannot recover anything against you because you are judgment proof. They cannot force you to make payments. However, if you want to make monthly payments, try and get an agreement on file with the court and have the attorney for the collection agency sign it. If you cannot get an agreement, then pay the court directly the monthly amount that you can afford.
