Legal Question in Credit and Debt Law in Indiana

Out of State Garnishment

I am a Kentucky resident that has been awarded a large judgement in a Kentucky Court against another Kentucky resident who works in Indiana. Can I garnish his wages and if so how do I go about it.

Re: Out of State Garnishment

As you have discovered, getting the judgment is only part of the battle. If the judgment debtor is employed by a company which you can serve in Kentucky (even though he works in Indiana) you may be able to garnish his wages directly. Otherwise, you may have to take your Kentucky judgment to Indiana state court, get it "localized" under the Full Faith and Credit provision of the Constitution, and then garnish his wages based on the Indiana judgment.

Does the defendant/debtor own any property in Kentucky???
