Legal Question in Credit and Debt Law in Indiana

Exchange of Credit Card Information ...

My website host notified me one day that the following week my website would be hosted by a different host! I was told that the new host would honor any existing hosting plans and payment plans. ( I had just recently paid for a full year of hosting.)

A week passed and sure enough my site had been transferred - I was contacted by the new host saying I would have supply my credit card information - Knowing I shouldn't be billed until 8/2002 I did not submit my credit card information to them ... a month later I received a charge on my card from this new company ... after just 3 months not the full year I had already paid for - and was told would be honored by the new host ... This charge was upsetting for multiple reasons - most importantly I had never given them my credit card information.

Is it legal for the previous company to supply this other entity with my credit card information - or should I have had to supply it to them as they had directed me to do so?

Best regards

Enzo

Re: Exchange of Credit Card Information ...

From the information you provide, the new website company has apparently committed an unauthorized use of your credit card. But the new company probably succeeded to the all the rights you gave the old company. You probably, somewhere in all the fine print, provided the old company with your credit card number. So the new company may have authority to possess the credit card information. But the main point is that they lacked authority from you to use it. Your remedies are simple: email the new company and demand immediate credit on your card and instruct them not to use your card any longer. Also advise your credit card company of this. The new company's conduct may also be the basis for a class action remedy for cash and modified corporate behavior, for which you can probably find many highly motivated attorneys.
