Legal Question in Credit and Debt Law in Indiana

humiliating collection

Can a known payday loan company call my employer, ask for me, and give their name?

They called my employer, and spoke with 3 people before they got to me. All of these people now know that I had a rough spot in my finances, and I am sure think much less of me. I am on the management team at my company because of my bachelor's in finance. The payday loan option was a last resort because of the high interest rates, but because of a large error in my checking account, it was do that or have bounced checks.

Re: humiliating collection

Your payday lender is not under the Fair Debt Collections Act because you owe them directly. The FDCPA only applies to third parties or debt collectors. So the short of it is, yes, if you gave them your work number, they can call you there. However, no one is allowed to harass you. Recommend that your employer tell them that your company doesn't allow those calls. That should put a stop to it as would paying the debt.
