PIF with cash 2 years later requesting money again
I took my car to be repaired 2 years ago to a dealership. I paid by check 1500.00. Because of a checking account error it was returned NSF. I went in and paid this amount in full with cash. They took my cash I was given a receipt and they told me my check would be mailed to me. The check was never mailed and I forgot about it. Now 2 years later they are demanding money again in full. Stating I never paid. When I called and talked to them they stated that the person 2 years ago who took care of the books was no longer with their company. They still have my check. They said the books were a mess but they could not find where I paid with cash. Do I have to pay this $1500 again? I have no clue where a receipt was over 2 years ago! They say they will sue me if I don't pay this amount. What should I do??

First, send the rude barbarians a written statement that you paid in cash. In the letter, point out to them that their loss of receipt books is evidence against them. Say if they attempt to collect this claim again, you will get a lawyer and sue them for punitive damages. Next, try to reconstruct how you acquired the cash - withdrawals from bank accounts, loans from ex-girlfriends (who are sometimes reluctant witnesses), whatever. So the lawyer you hire will have evidence with which to smite these unrighteous philistines hip and thigh. Good luck.
